Speakwise Terms of Service
These Terms of Service ("Terms") govern your use of Speakwise — the English-learning app and website at wespeakwise.com (together, the "Service"). By creating an account or using Speakwise, you agree to these Terms. If you do not agree, please do not use the Service.
How we handle personal data is described in our Privacy Policy, which is separate from these Terms.
1. The Service
Speakwise helps you practice spoken English with scenarios, learning activities, progress tracking, and feedback on fluency and clarity. Some features use on-device speech recognition; others may use cloud speech or AI providers to refine transcripts and coaching. Features may change, improve, or be limited over time.
Speakwise is an educational practice tool. It is not a substitute for formal language certification, professional tutoring, medical advice, or legal advice. Scores and AI feedback are estimates to help you practice — not guaranteed assessments of proficiency.
2. Eligibility and accounts
You must be at least 13 years old to use Speakwise. At sign-up we ask you to confirm this (self-attestation). You are responsible for your account credentials and for activity under your account. Keep your login details secure and tell us if you suspect unauthorized use.
You may create an account with email and password, Google Sign-In, Apple Sign-In, or phone where those options are offered. Provide accurate information and keep optional profile details up to date if you add them.
3. Acceptable use
You agree to use Speakwise only for lawful personal learning (or other lawful uses we expressly allow). You must not:
- Abuse, harass, or harm others, or submit illegal or infringing content
- Attempt to break, overload, or reverse-engineer the Service or its APIs
- Bypass security, rate limits, App Check, or access controls
- Use automated scrapers or bots in a way that harms the Service
- Resell, sublicense, or misrepresent Speakwise content as your own product
- Upload malware or interfere with other users' access
We may suspend or terminate access if we reasonably believe these rules were violated.
4. Your content and practice media
You keep ownership of content you create in Speakwise (for example practice transcripts, optional profile details, and recordings you make). You grant Speakwise a limited license to process that content as needed to operate the Service — scoring, progress, AI coaching, and account features — as described in the Privacy Policy.
Practice audio and video are primarily for your practice session. Speakwise does not keep a long-term cloud archive of practice video. Optional cloud speech may process audio briefly for transcription. You are responsible for content you choose to export or share outside the app.
5. AI feedback and third-party services
AI-powered scoring and coaching may send transcript text and prompts to providers that serve the request (for example Groq or OpenRouter), including optional keys you supply. Cloud speech may send short audio for transcription when that setting is on. Those providers process data under their own terms and privacy policies.
AI output can be incomplete or incorrect. Use feedback as practice guidance, not as a definitive grade or official certification.
6. Intellectual property
Speakwise, including its name, branding, UI, lesson structure, and original content we provide, is owned by Speakwise / its operators or licensors. These Terms do not transfer ownership of that material to you. You may use the Service for personal learning as intended by the app.
7. Availability and changes
We aim to keep Speakwise available, but we do not guarantee uninterrupted or error-free operation. Features may depend on your device, browser, network, or third-party services. We may update, suspend, or discontinue parts of the Service with or without notice when reasonably needed for maintenance, security, or product changes.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that scores, transcripts, or AI feedback will be accurate, complete, or suitable for any exam, job, or immigration purpose.
9. Limitation of liability
To the fullest extent permitted by law, Speakwise and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim (if any) or (b) USD $50.
Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the maximum extent allowed by law.
10. Account deletion and termination
You may delete your account in the app under Settings → Privacy & data. Deletion removes your Firebase Authentication account and associated Speakwise cloud data as described in the Privacy Policy. We may suspend or end access if you breach these Terms or if we shut down the Service.
11. Changes to these Terms
We may update these Terms as the product or law changes. We will update the "Last updated" date above when we do. Continued use after a change means you accept the updated Terms. If you do not agree, stop using the Service and delete your account if you wish.
